Skyaia recognizes the importance of protecting the privacy of all information provided by users of Skyaia products and services and our related websites. In Skyaia’s compliance with Congress passing the Gramm-Leach-Bliley Act, which contains certain privacy provisions, Skyaia is required to notify you of our Privacy Statement. Skyaia is committed to providing you with excellent service for all of our products. Privacy is of great concern to most users of the Internet, and your privacy is very important to us. Privacy is a critical part of an enjoyable and satisfactory user experience. We at Skyaia are acutely aware of and sensitive to the privacy concerns of our subscribers and other visitors to our Web site.  Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. Whether you are a customer of our various products and services or a visitor to our site, we assure you that we do not collect personal information from you unless you provide it to us. What Personally-Identifiable Information Is Collected?

Skyaia collects personally-identifiable information on certain areas of the Site when users register, donate, and participate in posting areas, such as bulletin boards, discussion forums, blogs, guest books and of the like. The personally-identifiable information collected may consist of information that you provide, such as names, mailing addresses, e-mail addresses, and telephone number. In addition, Skyaia collects certain information that you do not visibly enter, such as your IP address, browsing pattern on the Site, click stream, and the status of cookies placed on your computer by Skyaia, as described below:

Skyaia uses users’ IP addresses to help diagnose problems with our server and to administer our website. We also use it to gather broad demographic information about our users in general. This information does not contain anything that can identify users personally. We may combine demographic information supplied by a subscriber at registration with site usage data to provide profiles, in aggregate form, about our users and their preferences in the content of the site and advertising. Skyaia does not give advertisers information about individual users.

Using e-mail addresses provided at registration or otherwise, Skyaia periodically sends out “opt-in” e-mail newsletters and promotional e-mail to our users about services and products offered by Skyaia. Statistical Information About Your Visit

When you visit our site, our computers may automatically collect statistics about your visit. This information does not identify you personally, but rather about a visit to our site. How May Skyaia Use My Personally-Identifiable Information?

Skyaia uses your personally-identifiable information to fulfill your requests for information, to process your requests or any other inquiries that you may submit, or for such other business purposes as you may initiate or request. We may keep any of your personally-identifiable information on file and use it to contact you for recruiting purposes. Skyaia also uses personally-identifiable information to perform statistical analyses of user behavior in order to measure interest in specific areas and information posted on our Site. Skyaia uses personally-identifiable information collected from cookies and IP addresses as described below. Skyaia may provide your personally-identifiable information to any of its affiliates worldwide for such purposes.

Again, we do not collect any personal information from a visitor to our site unless that visitor explicitly and intentionally provides it. Under no circumstances do we collect any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, or sex life. Simply put, if you are simply browsing our site, we do not gather any personal information about you.

The Skyaia Blog is a forum for our members to express their opinions and ideas about climate, medicine, technology, health, government, disasters, and many other global topics. Some blogs, such as Dr. Atkins’ Blog, have additional Community Standards that apply only to them. For the blogs at large, as well as special or featured blogs, our Terms of Service apply. Please remain within the bounds of the Terms of Service. This document will strive to provide pointers for operating within the Skyaia community according to our policies.

Blogs/Discussions.

Blogs, or web logs, are a place for individuals to share their interests with other users of the Skyaia Community. Areas of the Site including the Skyaia Blog allow for public discussion of Skyaia-related ideas, facts and opinions. Skyaia is not an editor or publisher of the information, advice, ideas, statements, offers, sources or opinions (collectively, the Shared Information) supplied by third parties and users of the Site and does not have editorial control over such Shared Information. Any Shared Information expressed or made available by third parties are those of the respective author(s) or distributor(s) and not of Skyaia, its employees, agents, representatives or affiliates. Skyaia does not monitor the content of all the Shared Information twenty-four hours a day and, therefore, does not endorse and cannot be responsible for the appropriateness, accuracy or reliability of any Shared Information made by anyone other than Skyaia’s authorized employees and representatives while acting within the scope of their official capacities. You may post information that is appropriate for general readership. You may not post information that is objectionable, inappropriate or offensive for general readership. Skyaia is not responsible for or will have any liability with respect to the information contained in any websites that you may access as a result of such links including any objectionable or offensive content. Rules of the Road

  • Please do not carry on personal disputes in the blogs.
  • No personal attacks. This includes, but is not limited to: name calling, harassment or bullying toward any other member.
  • No hate speech of any kind is allowed.
  • Threats and intimidation will not be tolerated, and behavior of this type which extends into the real world will be dealt with by extreme action.
  • Foul or obscene language or content of any kind is not allowed.
  • Keep conversations on topic and avoid adult-only topic themes. Our site is open to users of all ages, so please respect others.
  • Do not circumvent a ban or any other administrative action by using another username or creating a new username.
  • No spam.

Responsibility

The “Rules of the Road” pertain to all types of content posted on our site, including media like videos, links or quotes originating from external sources. Generally, links to non-commercial (that is, personal) weather sites, personal sites/blogs, and especially photographers’ sites (even commercial) are allowed. However, if linked webpages or websites are found to contain content that goes beyond our own rules or is found to be abusive, the content and/or any reference to it will be removed. Removal of such content and any action taken against a member who violates our policies and/or Terms of Service is exercised at the discretion of Site Moderators and Admin.

You are solely responsible for all content you post on our site. We are not responsible for and do not review all user generated content on our site. However, we reserve the right to review, screen, delete, edit and/or move any content posted on our site, and without obligation.

Blog Author’s Privilege

Blog authors have generally free reign in their own blogs. They can ban anyone from their blog who is not an Admin. This privilege also comes with some responsibility. Please try to keep your blog free of content that is against these policies. Sometimes an administrator might be forced to set your blog to ignore or ban if there are rampant infractions within. Contact Skyaia Blog Admin if this happens in order to settle the matter.

Blog Moderation

Blog owners can always control moderation on their own blogs, and site moderators will step in only where and when it’s necessary. Additionally, there is the flagging system that all members are encouraged to use, and we ask that you keep these guidelines in mind when choosing to flag any content on the blogs.

Our featured blogs are more heavily monitored, due to significantly higher traffic, but site moderators are also frequently visiting community member blogs to ensure these rules are being adhered to. Like you, our blog moderators are bound to these same guidelines. And, when rules are broken, action is taken. Bans can either be temporary or permanent, depending on the offense.

Means of Action

Issues in the blog will be handled in the following ways:

  • Ignore – Having your blog removed from the directory, removing easy access to it. This is more like a warning and typically lasts 30 days, if there are no further problems.
  • Ban – This is strong action, as it removes your member handle from the blogs completely, blocking access to all entries. The length of a ban is dependent upon the severity of the violation. Bans may range anywhere from a few months, to a few years or permanent, depending on the offense.
  • IP Ban – People who repeatedly circumvent bans will be the recipients of an IP ban, which blocks access to the entire site.
  • Troll Wipe – This is the most extreme action an Admin can take, and it is reserved for flagrant, repetitive violations of the Terms of Service. This will remove the user completely, making it impossible for them to access that member handle again.

Skyaia Blog Admin

Skyaia Blog Admin is a generic handle used by our employees to interact with bloggers. This gives a single point of contact for our members to report issues and dispute bans. As noted in our Terms of Service, Skyaia does not maintain 24/7 watch over the blogs and administration is not real time. Administrators will deal with problems and answer messages that warrant a reply when they can, so please be patient.

If you have any questions about these rules please send an email to Skyaia blog admin.  Due to the high amount of traffic that Dr. Atkins’ blog receives, a special community standard has been established for the blog. The following list comprises the “Rules of the Road” for Dr. Atkins’ blog.

  • Keep it civil. Personal attacks, bickering, flaming, and general trollish behavior will not be tolerated. Disagreements are fine, but keep them civil and short.
  • Stay on topic.
  • No monomania.
  • No hot linking external or copyright images without the image owner’s permission.
  • Do not circumvent a ban. If you create a new username to circumvent a ban, you will be blocked from the site completely.
  • No comments that contain only personal notes such as, “Good Morning!”, or “You’ve got mail, X”.
  • Do not “1st!”, “1st post!”, or any of the numerical/linguistic derivatives. This is a worthless use of blog space.
  • No spamming.
  • No spamming.
  • Seriously, no spamming. Spamming includes but is not limited to, trying to sell products, trying to solicit traffic for your own blog, trying to solicit traffic for other commercial entities, etc. Do not post links to your own site unless they are directly relevant and even then, use sparingly.
  • Political comments are allowed, as long as they’re in reference to the blog topic.

Do not enter games of one-upmanship with trolls or bloggers you find to be annoying. You will be banned alongside them, as your verbal jousts consume the space and time everyone else is sharing. If you come across a troll or another blogger whom you find to be irritating, please use the site reporting tools and y our ignore list.

7. Unauthorized Use / No Interference.

You agree that you will not use or attempt to use any method, device, software or routine to harm others or interfere with functioning of the Site or use and/or monitor any information in or related to the Site for any unauthorized purpose. Specifically, each Participant, whether authorized or unauthorized, agrees that it will not (and will not permit any of its employees, agents, and any other third party) do any of the following:

  • Upload, post, email, transmit or otherwise make available any Data or content on the Site as to which you do not possess all of the patent, trademark, copyright, trade secret, license or other rights to do so;
  • Violate any applicable laws and regulations, whether federal, state, local, foreign or international, applicable to the Site, its Data and/or your use of either, including without limitation U.S. export and re-export control laws and regulations, and you will not otherwise engage in any illegal, manipulative or misleading activity through use of this Site or its Data;

By submitting information to Skyaia, you automatically grant, or warrant that the owner of such material has expressly granted Skyaia a royalty-free, worldwide, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, display, translate and distribute such material (in whole or in part) and/or to incorporate it in other works in any form, media or technology now known or hereafter developed. The Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for insuring that materials submitted for inclusion on the Site are accurate and comply with applicable laws. Skyaia will not be responsible for the illegality of or any error in accuracy in any advertisers. or sponsors. materials. participant understands and agrees that, in order to provide for the use of this Site, Skyaia contracts with certain vendors and service providers, which have certain rights, limitations of warranties, and limitations of liability in those contracts. Participant understands and agrees that it is not a third party beneficiary under any such agreements, that it has no rights whatsoever pursuant to such agreements, and that it has no contractual or other relationship with any advertiser, business affiliate, vendor or service provider by reason of the use or information provided on this Site or any agreement relating to the Site. Without limiting the foregoing, Skyaia shall have the right, but not the obligation, to remove any material we in our sole discretion, find to be in violation of the provisions hereof or otherwise objectionable. However, any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers and users, are those of the respective author(s) or distributor(s) and not that of Skyaia.

10. Viruses.

We will use commercially reasonable efforts to maintain the Site free of viruses and other harmful components. However, as the Site is accessible by third parties, we cannot assume any responsibility for any viruses or other harmful components that may affect your computer equipment or other property as a result of your access to, viewing of or downloading any Data from the Site. We do not warrant that the Site, its servers or any Data downloaded from the Site is free from viruses, bugs or other harmful components.

11. Limitations

In no event shall Skyaia or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Skyaia’s Internet site, even if Skyaia or a Skyaia authorized representative has been notified orally or in writing of the possibility of such damage.
